Rule 6.16 More Draconian than former PG&E power passthrough rule Section 4.11

IS THERE ANY JUSTIFICATION FOR ANY PASSTHROUGH?

Contesting Golden Gateway Center's (GGC) Power Passthrough based on 1980 as a base year and 2006 as a comparison year (advances each year). This passthrough added $99.05 to my rent. The San Francisco Rent Board allows GGC to subtract their power-utility bill in 1980 (unindexed for rent or CPI increases) from their power-utility bill in 2006 and pass on the difference by a room proration formula. The Rent Board uses Rule 6.16 to justify this type illogical calculation. It replaced Section 4.11. Rule 6.16 is more draconian in that it counts garage parking spaces as "rooms." Memo: Neighbors at the Golden Gateway Center (GGC) that received PG&E power filing L070158.

In November, 2007, I questioned GGC's Rent Board Ordinance Rule 6.16 passthrough to me of $99.05/month. I filed a petition with the San Francisco Rent Stabilization and Arbitration Board. I believe GGC's passthrough request was meritless.

I did not suspect that the Rent Board would use my personal petition to justify the the current R6.16 passthrough via a general and public distribution. Concerns should be addressed to the Rent Board. I followed Rent Board guidelines to object to GGC's power passthrough using 1980 as the base year and 2006 as the comparison year. My filing and appeal are attached.

Should they uphold my appeal, however, I would hope any positive externalities will benefit neighbors.

I am appealing their decision. This is my own personal appeal, executed according to the Rent Board rules and regulations. This appeal will be heard on January 22, 2008 at the Rent Board at 6 PM.
